Section R. 323.2117 - Public notice of permit application and preliminary determinationsRule 2117.
(1) The department shall prepare and sign a public notice of an application for a national permit, or a state permit as deemed appropriate by the department, and of the proposed determination to issue or deny a permit for the proposed or existing discharge identified in the application. The notice shall be circulated within the geographical area of the proposed or existing discharge in 1 or more of the following ways:(a) Posting of the notice in the post office or other public buildings of the municipality nearest the premises of the applicant in which the discharge is or will be located.(b) Posting of the notice at the entrance to the applicant's premises or nearby.(c) Publishing the notice in 1 or more newspapers of general circulation in the area of the applicant, or if appropriate, in an applicable periodical.(2) A copy of the notice shall be transmitted to the permit applicant and shall be available at the department office in Lansing and at the department district office nearest to the geographical location of the applicant.
