Section R. 324.1210 - Administrative complaint; notice of hearing

Rule 1210.

(1) The staff of the supervisor may file an administrative complaint with the supervisor. An administrative complaint shall set forth the nature of the violations complained of and shall specifically cite the provisions of the act, these rules, permit conditions, instructions, or orders of the supervisor allegedly violated. The supervisor shall select a date for the hearing and prepare a notice of hearing. Upon request, the person alleged to be in violation shall provide, to the supervisor, a list of the last known names and addresses of all persons of record with the register of deeds who own oil and gas interests within the unit. The notice of hearing and administrative complaint shall be served by certified mail, return receipt requested, on the person alleged to be in violation, the operator, the surety, and other interested persons as the supervisor shall consider necessary or appropriate. The notice shall be served not less than 21 days before the hearing date. The hearing shall be a hearing before the supervisor.
(2) A hearing held pursuant to an administrative complaint shall be a hearing before the supervisor pursuant to R 324.1205.
