Section R. 299.4449 - Type II landfill operation; post-closureRule 449.
(1) After the final closure of each unit, the owner and operator of a type II landfill shall conduct post-closure care for not less than 30 years, which includes all of the following:(a) Maintaining the integrity and effectiveness of any final cover, including repairs to the cover as necessary to correct the effects of settling, subsidence, erosion, or other events, and preventing run-on and runoff from eroding or otherwise damaging the final cover.(b) Maintaining, operating, and monitoring the leachate collection system in accordance with the requirements specified in R 299.4423 and R 299.4432.(c) Monitoring the groundwater in accordance with these rules and maintaining the groundwater monitoring system.(d) Monitoring all secondary collection systems and leak detection systems in accordance with the requirements of R 299.4432.(e) Maintaining and operating the gas monitoring and collection system in accordance with the requirements of R 299.4433.(2) The owner and operator shall not remove any of the following from the facility without the approval of the director or his or her designee:(a) Waste or waste residues, except leachate, gas, and gas condensate.(3) After completion of the post-closure care period for each disposal unit, the owner and operator shall submit, to the director or his or her designee, certification which is signed by an independent registered professional engineer and which verifies that post-closure care has been completed in accordance with the act, these rules, and the post-closure plan.(4) The director, or his or her designee, shall, within 60 days of receiving a post-closure certification, provide the owner or operator with a written statement of the reason or reasons for the director's belief that post-closure has not been in accordance with the act, these rules, or the approved post-closure plan. In such case, the post-closure period shall be extended until deficiencies are corrected and a post-closure is recertified.(5) The approved post-closure certification shall be placed in the operating record.Mich.
