Section R. 299.9614 - Use and management of containersRule 614.
(1) Owners or operators of all hazardous waste facilities that store containers of hazardous waste shall do both of the following: (a) Comply with all requirements of 40 C.F.R. part 264, subpart I. If the owner or operator is unable to comply with 40 C.F.R. §264.176 or the authority having jurisdiction determines that an alternative to the requirements of 40 C.F.R. §264.176 is more protective of human health and the environment, then compliance with 40 C.F.R. §264.176 is considered achieved by meeting the requirements of the fire prevention code and its rules. A copy of an approval letter indicating that the containers are stored in compliance with the fire prevention code and signed by the authority having jurisdiction shall be maintained at the facility.(b) Ensure that each container is labeled or marked clearly with the words "Hazardous Waste" and the hazardous waste number.(2) The provisions of 40 C.F.R. part 264, subpart I, are adopted by reference in R 299.11003.Mich.
