(1) The owner or operator shall provide to the director or the director's designee the data necessary for the department to prepare and submit Michigan's hazardous waste report as required to the EPA. The owner or operator shall submit the data in a format specified by the director or the director's designee. The data must be acquired from the information required in parts 3 and 6 of the rules, the operating reports required in subrule (3) of this rule, other reporting mechanisms used by the director to obtain the information specified in 40 CFR 264.75, and by the EPA as part of a federal information collection request published in conjunction with 40 CFR 264.75.(2) If a facility accepts for treatment, storage, or disposal any hazardous waste from an off-site source without an accompanying manifest or without an accompanying shipping paper as described in 40 CFR 263.20(e), and if the waste is not excluded from the manifest requirement by R 299.9304, then the owner or operator shall prepare and submit a single copy of a report to the director or his or her designee which the within 15 days after receiving the waste. The unmanifested waste report must be submitted on a form approved by the director. The report must be designated "Unmanifested Waste Report" and must include all of the following information: (a) The site identification number, name, and address of the facility.(b) The date the facility received the waste.(c) The site identification number, name, and address of the generator and the transporter, if available.(d) A description and the quantity of each unmanifested hazardous waste and facility received.(e) The method of treatment, storage, or disposal for each hazardous waste.(f) The certification signed by the owner or operator of the facility or the owner or operator's authorized representative.(g) A brief explanation of why the waste was unmanifested, if known.(3) The owner or operator of a hazardous waste treatment or disposal facility on the site of generation shall submit an operating report to the director or his or her designee, on forms provided by the director, which summarizes all managed hazardous wastes treated or disposed of, including the hazardous waste number of the wastes, quantity, method of treatment or disposal, and dates of treatment or disposal. The report must be submitted to the director within 10 days after the end of March, June, September, and December of each year, unless more frequent submissions are required by the director or his or her designee.(4) All reports must be signed and certified pursuant to 40 CFR 270.11, which is adopted by reference in R 299.11003.(5)40 CFR 263.20(3) is adopted by reference in R 299.11003.Mich.
