Section 28.02.01.08 - Representation of Parties at HearingsA. In all Office proceedings: (1) An individual may represent himself or herself; and(2) A person may be represented by an attorney authorized to practice law in Maryland.B. When authorized pursuant to State Government Article, § 9-1607.1, Annotated Code of Maryland, or otherwise by law, a person may appear through or be represented by an individual who is not an attorney.C. Power of Attorney. (1) An employee of a business entity who is representing that business entity in accordance with State Government Article, § 9-1607.1, Annotated Code of Maryland, shall provide the Office with a power of attorney.(2) The Office shall accept any properly executed power of attorney meeting the requirements of State Government Article, § 9-1607.1, Annotated Code of Maryland.(3) The Office may provide a form for a power of attorney.(4) A power of attorney required by this regulation may be:(a) Kept on file with the Office;(b) Provided to the ALJ: (i) At the outset of a hearing in which the power of attorney is required; or(ii) In the discretion of the ALJ, before the close of the record.D. A party's representative shall enter or withdraw the representative's appearance with the Office.E. A party's representative of record shall be served with all notices, pleadings, and other correspondence.Md. Code Regs. 28.02.01.08
