Section 26.21.01.25 - Landfills

A. If any part of the affected land is to be used as a landfill during mining or upon completion of mining, the Department may suspend the reclamation requirements for the area.

B. The permittee shall obtain the prior written approval of the Maryland Department of the Environment and any other appropriate State, county, or local agency before engaging in landfilling activities.

C. The permittee shall provide a time schedule to the Department for the orderly and timely completion of the landfill.

D. Lands used for a landfill shall continue under performance bond for the benefit of the Department until the land is approved by the Department for release.

E. The performance bond may be released if the Maryland Department of the Environment or other appropriate regulating agency approves a performance bond that is equal to or greater than the amount of bond held by the Department and if the bond provides that the mined area will be adequately reclaimed.
