Section 26.20.02.02 - General Application Information

A. Information set forth in the application shall be current, presented clearly and concisely, and supported by appropriate references to technical and other written material available to the Bureau. All technical data submitted in the application shall be accompanied by the names of persons or organizations which collected and analyzed the data, the dates of the collection and analyses, and the descriptions of methodology used to collect and analyze the data. Technical analyses shall be planned by or under the direction of a professional qualified in the subject to be analyzed. The application shall state the name, address, and position of officials of each private or academic research organization or governmental agency consulted by the applicant in preparation of the application for information on land uses, soils, geology, vegetation, fish and wildlife, water quantity and quality, air quality, and archeological, cultural, and historic features.

B. Maps submitted with applications shall include all types of information that are set forth on 7.5 minute topographic maps of the U.S. Geological Survey. Maps of the permit area, the mine plan area and within 1/2 mile of the mine plan area shall be at a scale of 500 feet to the inch or larger. Maps of the adjacent areas shall clearly show the lands and waters within those areas and be at a scale of 1 inch equals 2,000 feet or larger.

C. Maps and plans submitted with the applications shall distinguish among each of the phases during which surface coal mining operations were or will be conducted at any place within the mine plan area. At a minimum, distinctions shall be clearly shown among those portions of the mine plan area in which surface coal mining operations occurred before August 3, 1977; after August 3, 1977, and before May 3, 1978; after May 3, 1978, and before the effective date of these regulations; and after the estimated date of issuance of a permit by the Bureau.

D. Each application for a surface coal mining and reclamation permit pursuant to the Regulatory Program shall be accompanied by a $10 fee.

E. Applications for permits shall be submitted on forms provided by the Bureau and shall be verified under oath, by a responsible official of the applicant, that the information contained in the application is true and correct to the best of the official's information and belief.

F. All water quality analyses performed to meet the requirements of this chapter shall be conducted according to the methodology required by 30 CFR § 780.21. Modeling techniques, interpolation, or statistical techniques may be included as part of a permit application, but actual surface and ground water information may be required by the Bureau when these techniques are used.
