Section 26.13.07.02-9 - Specific Information Requirements for Miscellaneous Units
A. In addition to complying with the requirements of Regulation .02 of this chapter, a person seeking a CHS facility permit for a hazardous waste management facility that uses, or is proposed to use, miscellaneous units to manage hazardous waste shall provide the Secretary with the specific information required by §B of this regulation.
B. For facilities that treat, store, or dispose of hazardous waste in miscellaneous units, except as otherwise provided in COMAR 26.13.05.16 s -1A, the permit applicant shall provide the following additional information:
(1) A detailed description of the unit being used or proposed for use, including the following:
(a) Physical characteristics, materials of construction, and dimensions of the unit;
(b) Detailed plans and engineering reports describing how the unit will be located, designed, constructed, operated, maintained, monitored, inspected, and closed to comply with the requirements of COMAR 26.13.05.16 s -1B and C; and
(c) For disposal units, a detailed description of the plans to comply with the post-closure requirements of COMAR 26.13.05.16 s -1D;
(2) Information that addresses and assures compliance of the unit with each factor in the environmental performance standards of COMAR 26.13.05.16 s -1B, consisting of either:
(a) Detailed hydrologic, geologic, and meteorologic assessments and land-use maps for the region surrounding the site; or
(b) The following:
(i) A demonstration, to the Secretary's satisfaction, that the unit meets the environmental performance standards of COMAR 26.13.05.16 s -1B, and
(ii) Preliminary hydrologic, geologic, and meteorologic assessments;
(3) Information on the potential pathways of exposure of humans or environmental receptors to hazardous waste or hazardous constituents and on the potential magnitude and nature of the exposures;
(4) For any treatment unit, a report on a demonstration of the effectiveness of the treatment based on laboratory or field data;
(5) Any additional information determined by the Secretary to be necessary for evaluation of compliance of the unit with the environmental performance standards of COMAR 26.13.05.16 s -1B.
