Notes:

1. The construction of new residual oil fuel-burning equipment under 13 MM Btu (13.7 gigajoules) per hour is prohibited under Regulation .04.
2. The construction of new solid fuel-burning equipment under 13 MM Btu (13.7 gigajoules) per hour is prohibited unless an exception has been approved by the Department (see Regulation .04).
3. New fuel-burning equipment over 250 MM Btu (263.8 gigajoules) per hour are regulated by NSPS source regulations COMAR 26.11.06.12.
4. Depending on load factor, fuel ash content, and control equipment, fuel-burning equipment which has a heat input greater than approximately 25 MM Btu (26.4 gigajoules) per hour may be subject to Prevention of Significant Deterioration Review (40 U.S.C. Part § 52.21) and consequent additional control requirement.
