Section 26.04.07.17 - Sanitary Landfills - Rubble Landfills - Other Requirements
A. Public Hearing-Before issuing a permit for a sanitary landfill to accept rubble, a public hearing shall be conducted in accordance with the provisions of Regulation .09A of this chapter.
B. Before the Department issues a permit for a sanitary landfill to accept rubble, the applicant shall satisfy the provisions of Regulation .09B and C of this chapter and the requirements of Environment Article, § 9-210, Annotated Code of Maryland, shall have been completed.
C. Reporting Requirements.
(1) An annual written report shall be submitted by the permittee to the Approving Authority concerning the status of a sanitary landfill restricted to accepting rubble for each year the facility is in use. This report shall be submitted not later than 60 days following the date specified in the permit and shall include the:
(a) Quantity of solid waste, stated in tons and in-place cubic yards, received per month for each month of the calendar year being reported;
(b) Percentage of total capacity of the landfill used for emplacement of solid waste;
(c) Projected date the landfill will reach capacity and the basis upon which the determination was made; and
(d) Type and quantity of materials, given in tons for each type of material, recycled at the facility per month for each month of the calendar year being reported, if scavenging or processing of materials is authorized by the permit.
(2) The permittee is required to periodically report to the Department, at a frequency established by the Approving Authority, the results of ground and surface water samples collected on the permitted site and the volumes and chemical characteristics of leachate or other contaminated liquid collected from the landfill.
D. Other Requirements.
(1) New rubble landfills or waste cells of existing rubble landfills constructed after September 22, 1997, shall comply with the requirements in Regulation .16 of this chapter. This requirement shall be applicable to vertical expansion of existing landfilled areas filled before the referenced date.
(2) Rubble landfills accepting waste before September 22, 1997, shall submit to the Approving Authority, within 120 days of the effective date, a schedule for the installation of a liner and leachate collection system to comply with the requirements of Regulation .16 of this chapter for the existing landfill. The schedule shall be subject to approval by the Approving Authority. Rubble landfills accepting waste as of the effective date of this regulation shall meet the requirements of the regulation by July 1, 2001, or cease operations and begin closure of the landfill.
(3) Changes or modifications to approved plans or specifications required by the Department made to comply with the requirements of §D(1) and (2) of this regulation shall be submitted to the Approving Authority in accordance with a schedule approved by the Department.
(4) The Department may impose other requirements considered necessary.
