Section 21.10.06.11 - Submission Without a Hearing

Either party may elect to waive a hearing and to submit its appeal upon the record before the Appeals Board, as settled pursuant to Regulation .13 of this chapter. As agreed to by the parties, affidavits, depositions, and answers to interrogatories may be employed to supplement other documentary evidence in the Appeals Board record. The Appeals Board may permit the submission to be further supplemented by oral argument (transcribed if requested), and by briefs arranged in accordance with COMAR 21.10.05.12.S ubmission of an appeal without hearing does not relieve the parties from the necessity of proving the facts supporting their claims or defenses.
