Section 10.15.04.23 - Traceability, Sampling, and DetentionA. The person-in-charge shall ensure that: (1) Records are maintained that allow for traceability of food or food ingredients received by the food processing plant that include the: (b) Previous source's: (iii) Contact information;(2) Records are maintained that allow for traceability of food and food ingredients that identify the initial distribution of the food that include: (a) The date the food was released;(b) A lot code number or other identifier, if available;(c) The type of food released, including brand name and specific variety; and(d) For the transporter of the food and the intended immediate recipient, the:(iii) Contact information;(3) All records maintained that allow for traceability are made available to the Department for review and copying upon request; and(4) The collection of food and environmental samples by the Department is allowed in accordance with Health-General Article, §§21-249 and 21-251, Annotated Code of Maryland.B. The Department shall: (1) Collect food and environmental samples as often as necessary for enforcement of this chapter;(2) Sample food in accordance with Health-General Article, §§21-249 and 21-251, Annotated Code of Maryland; and(3) Take action on a food where indicated in accordance with Health-General Article, §§21-211, 21-253, and 21-254, Annotated Code of Maryland, by: (a) Issuing a detention order;(b) Seeking voluntary destruction; or(c) Filing a petition for an order of forfeiture for destruction.Md.
