Section 10.09.37.03 - Eligibility for Family Planning Program CoverageA. In order to be determined eligible for benefits under the Family Planning Program, an applicant: (1) Shall: (a) Have a household income that does not exceed 250 percent of the federal poverty level; and(b) Meet the following requirements: (i) Citizenship requirements in COMAR 10.09.24.05B;(ii) Identity requirements in COMAR 10.09.24.05B -1(a)-(e) and (g); and(iii) Residency requirements in COMAR 10.09.24.05-3. (2) May not: (b) Be determined eligible for another Medical Assistance Program;(c) Be enrolled in Medicare; or(d) Be an incarcerated inmate in a public institution as defined in COMAR 10.09.24.05B -5B.B. An applicant whose income does not exceed 250 percent of the federal poverty level and is determined eligible for pregnancy or postpartum coverage under COMAR 10.09.24 shall be: (1) Enrolled for 1 year without filing a separate application after pregnancy related period of eligibility ends; and(2) Redetermined for eligibility based on the criteria in §A of this regulation.Md.
