Section 10.03.01.10 - Birth Certificate of a Deceased Person

A. On presentation of an official death certificate, a birth certificate on a deceased individual may be issued to:

(1) A parent;

(2) A surviving spouse;

(3) A legal guardian; or

(4) An authorized representative of the deceased who presents an affidavit attesting to the purpose for obtaining the record.

B. The birth record shall be stamped "DECEASED" and the date of death shall be recorded on it.
