Section 10.01.15.03 - Definitions-For Exemption from Self-Referral LawsA. In this chapter, the following terms have the meanings indicated.B. Terms Defined. (1) "Area of concentration" means a limitation of practice by demonstrable training and competence of a health care practitioner.(2) "Essential" means a health care entity would not be able to exist but for the health care practitioner's beneficial interest in the health care entity.(3) "Health care entity" means a business entity that provides health care services for the: (a) Testing, diagnosis, or treatment of human disease or dysfunction; or(b) Dispensing of drugs, medical devices, medical appliances, or medical goods for the treatment of human disease or dysfunction.(4) Health Care Practitioner. (a) "Health care practitioner" means a person who is licensed, certified, or otherwise authorized under the Health Occupations Article, Annotated Code of Maryland, to provide health care services in the ordinary course of business or practice of a profession.(b) "Health care practitioner" does not include a mortician or nursing home administrator, unless the mortician or nursing home administrator is licensed, certified, or otherwise authorized under the Health Occupations Article, Annotated Code of Maryland, to provide health care services by any board other than the Board of Morticians or the Board of Nursing Home Administrators.(5) "MHCC" means the Maryland Health Care Commission.(6) "Secretary" means the Secretary of Health and Mental Hygiene.(7) "Specialty" means "area of concentration" as defined in §B(1) of this regulation.Md.
