Section 08.03.08.09 - Species in Need of Conservation
A. Listing Criteria. The following factors shall be considered for listing a species as in need of conservation:
(1) Whether the population is limited or declining within Maryland; and
(2) Whether the species may become threatened in the foreseeable future, if current trends or conditions persist.
B. Permits. The permit procedures to be followed are set forth in Regulation .03 of this chapter. The following apply:
(1) Except by special permit, a person may not take, export, possess, process, sell, offer for sale, deliver, carry, transport, or ship by any means any species in need of conservation;
(2) Permits to take species in need of conservation shall be issued only for:
(a) Scientific research designed to enhance the recovery of the species or population;
(b) Other valid scientific research; or
(c) Educational purposes designed to further public awareness regarding the species.
(3) Incidental taking permits are not required for species in need of conservation.
C. The following species are considered to be in need of conservation throughout Maryland unless a smaller range is indicated:
(1) Mollusks:
(a) Atlantic spike (Elliptio producta);
(b) Appalachian springsnail (Fontigens bottimeri);
(c) Cherrystone drop (Hendersonia occulta); and
(d) Creeper (Strophitus undulatus);
(2) Crustaceans:
(a) Acuminate crayfish (Cambarus acuminatus);
(b) Allegheny amphipod (Stygobromus allegheniensis); and
(c) Franz's amphipod (Stygobromus franzi);
(3) Insects:
(a) Pepper-and-salt skipper (Amblyscirtes hegon);
(b) Olympia marble (Euchloe olympia);
(c) Silvery blue (Glaucopsyche lygdamus);
(d) Giant swallowtail (Papilio cresphontes);
(e) Rapids clubtail (Phanogomphus quadricolor); and
(f) Sable clubtail (Stenogomphurus rogersi);
(4) Finfish:
(a) Flier (Centrarchus macropterus);
(b) Pearl dace (Margariscus margarita); and
(c) Striped shiner (Luxilus chrysocephalus);
(5) Amphibians- Wehrle's salamander (Plethodon wehrlei);
(6) Reptiles-Eastern spiny softshell (Apalone spinifera);
(7) Birds:
(a) Saltmarsh sparrow ( Ammospiza caudacuta);
(b) Henslow's sparrow ( Centronyx henslowii);
(c) Northern harrier (Circus hudsonius);
(d) Alder flycatcher (Empidonax alnorum);
(e) American peregrine falcon (Falco peregrinus anatum);
(f) Common gallinule (Gallinula galeata);
(g) Least bittern (Ixobrychus exilis);
(h) Coastal Plain swamp sparrow (Melospiza georgiana nigrescens);
(i) Northern waterthrush (Parkesia noveboracensis);
(j) Forster's tern (Sternaforsteri);
(k) Barn owl (Tyto alba); and
(I) Golden-winged warbler (Vermivora chrysoptera);
(8) Mammals:
(a) Bobcat (Lynx rufus);
(b) Least weasel (Mustela nivalis);
(c) Delmarvafox squirrel (Sciurus niger cinereus);
(d) Long-tailed shrew (Sorex dispar);
(e) Smoky shrew (Sorex fumeus); and
(f) Appalachian cottontail (Sylvilagus obscurus).
