Section 118-5-9 - Organizational Structure
9.1Minimum Clinical Staff. Each substance abuse program shall have a minimum of 1.5 clinical staff directly employed by the agency. The minimum must include one (1) full-time clinical staff and 0.5 FTE (full-time equivalent) of clinical staff. For purposes of this rule, FTE is defined as no less than 30 hours a week. The agency shall not count affiliate counselors to meet the 0.5 FTE requirement. An Alcohol and Drug Counselor Aide (ADCA) is not considered clinical staff.
9.2Staff Credentials.
9.2.1 Only the following are included in the definition of clinical staff:
9.2.1.1 A Licensed Alcohol and Drug Counselor (LADC) and a Certified Alcohol and Drug Counselor (CADC); or
9.2.1.2 a Registered Nurse certified as a Psychiatric Nurse, an Advanced Practice Registered Nurse (APRN) with appropriate specialization certification, a Medical Doctor (M.D.), a Doctor of Osteopathy (D.O.), a Licensed Clinical Psychologist, a Licensed Clinical Social Worker (LCSW), a Licensed Clinical Professional Counselor (LCPC), or a Licensed Marriage and Family Therapist (LMFT): when any listed in this section [9.2.1.2] has completed one (1) year clinical experience in substance abuse treatment and a minimum of sixty (60) hours of alcohol and drug education within the last five (5) years. Education accepted by the licensing authority includes, but is not limited to, training and continuing education approved by the Maine State Board of Alcohol and Drug Counselors, 2-384 Code of Maine Rules [C.M.R.] Chapters 1-9.
9.2.2 Staff credentials must be congruent with COD-Capable programming. See the definition of COD-C program at Section 1.17.1 and the definition of a clinical supervisor's COD-C credentials at Section 11.1.1.2.
9.2.3 The agency is responsible to demonstrate that its pattern of staffing, licensure, credentialing, and training, including access to supervision and consultation, is adequate for the volume and characteristics of the target population, including those with co-occurring conditions. Agencies must ensure that staff providing services as the primary provider of a client, particularly to clients with co-occurring disorders, are acting within the scope of their individual license to meet the needs of the target population.
9.2.4 Agencies with multidisciplinary teams must ensure that those teams hold the range of licenses appropriate to meet the needs of the target population.
9.3Staff Responsibilities. The professional staff referred to in Section 9.2 shall be responsible for the provision of direct services to clients. The professional staff shall ensure that a full range of formal treatment services is available to each client in conjunction with the structured set of activities routinely provided by the program and in accordance with the individual client's needs.
9.3.1 There shall be a job description for all employees, including part-time personnel, which includes qualifications, responsibilities, and lines of authority.
9.3.2 The program shall document the pattern of staff coverage throughout the treatment day.
9.3.3 Persons who are providing client services under contract to the program shall abide by the same policies and held to the same standards as agency employees. See Section 13.
9.4Table of Organization. The agency shall maintain a current table of organization.
9.4.1 The table of organization shall clearly describe the functional lines of authority, oversight, management and consultative relationships between each and every position, body, or board depicted in the table of organization.
9.4.1.1 Services provided through contracted relationships shall be so identified on the table of organization.
9.5Job Descriptions.
9.5.1 Written Job Descriptions. The agency shall develop and revise as needed written job descriptions for all positions within the agency, which include minimum qualifications and job responsibilities.
9.5.1.1 A signed copy of the job description shall be included in the employee's personnel file.
9.5.1.2 The agency shall provide a copy of the job description to each employee at the time of hire, promotion, or orientation.
9.6Access by Managers. The agency shall ensure access to job descriptions within the individual's chain of command to every person who has management or supervisory responsibilities.
