Section 148-31-8 - APPEALS
A.Informal Review. A Program may request an Informal Review of its Star Rating by contacting the CCDF Administrator in writing.
1. The Department will review all appropriate documentation related to the Star Rating of the Program to determine if the correct Star Rating has been assigned.
2. The Department will notify the Program of its decision on the Informal Review in writing within thirty (30) business days.
a. During the Informal Review process, the requested Program will remain at the higher Star Rating.
B.Administrative Hearing. If the Program is not satisfied with the outcome of the Informal Review, they may pursue further appeal by requesting an Administrative Hearing.
1. A Program must request an Informal Review and obtain a decision before requesting an Administrative Hearing.
2. To appeal the result of an Informal Review, the Program must request an Administrative Hearing within ten (10) calendar days of receiving the Department's decision.
3. Subsequent appeal proceedings will be limited only to those issues raised in the Informal Review.
a. The Office of Administrative Hearings shall notify the Program in writing of the date, time, and place of the hearing, and shall designate a hearing officer.
b. The hearing shall be held in conformity with the Maine Administrative Procedures Act, 5 M.R.S.A. § 8001et seq. and the Administrative Hearings Regulations, 10-144 C.M.R. ch. 1.
