After January 1, 2002, a manufacturer or retailer may not sell a mercury-added product in Maine unless the manufacturer does one of the following:
A retailer may not be found in violation of this requirement if the retailer lacked knowledge that the product contained mercury.
NOTE: A person who sells mercury-added lamps in bulk for use in industrial, commercial or office buildings must inform the purchaser in writing, on the sales invoice or in a separate document, that the lamps contain mercury and must be managed as hazardous waste in accordance with the requirements of the Maine Hazardous Waste Management Rules.
