Section XXIII-1107 - Waiver of RestrictionsA. No commercial applicator shall apply any of the pesticides listed in §1103. B in the parishes and during the periods specified in §1103. C without written authorization from the commissioner prior to such application, except as described in §1103 PB. The commissioner may waive the time restrictions on application of pesticides listed in §1103. B upon written request, as follows. 1. Any commercial applicator desiring a waiver of any restriction contained in §1103 shall apply to the commissioner at least 24 hours prior to the date scheduled for application of the pesticide.2. The application for waiver shall be submitted on a form provided by the commissioner and shall contain the following information: a. the name and address of the person requesting the application;b. the name of the applicator who will actually make the application;c. the name of the owner-operator, if different from the applicator making the application;d. the location where the application will be made, including the crop and name and address of the landowner;e. the proposed date and hour when the application is scheduled; andf. any other information pertinent to the specific waiver application which may be required by the commissioner.C. Both the commercial applicator and the person for whom the pesticide application will be made must sign and date the waiver application.La. Admin. Code tit. 7, § XXIII-1107
