Section V-8001 - Scope and AuthorityA. This Chapter, adopted pursuant to R.S. 36:254(B)(7), the federal Safe Drinking Water Act (42 USC 300f et seq.) and its implementing regulations (40 CFR Parts 141 and 143), and the State Sanitary Code (LAC 51) constitutes the Department of Health, Office of Public Health (hereinafter referred to as "department") regulations governing the certification of laboratories performing drinking water analyses required to be performed by regulations or orders issued pursuant to those acts and regulations. The authority of the department to grant, maintain or revoke a laboratory's State Certification shall not be delegated to an outside person or body. Portions of the certification process may be contracted out by the department but the authority to grant, maintain, suspend or revoke certification remains with the department. This Chapter establishes the procedures for obtaining and maintaining certification, and the criteria and procedures laboratories shall follow in analyzing drinking water samples.La. Admin.
