Section I-8505 - Licensing RequirementsA. All ICF/DD providers shall be licensed by the Department of Health and Hospitals. An ICF/DD shall not be established, opened, operated, managed, maintained, or conducted in the state without a license issued by DHH. Each ICF/DD shall be separately licensed.B. DHH is the only licensing authority for ICF/DD providers in the state of Louisiana. It shall be unlawful to operate an ICF/DD provider without possessing a current, valid license issued by the department.C. Each ICF/DD license shall: 1. be issued only to the person or entity named in the license application;2. be valid only for the ICF/DD provider to which it is issued, and only for the specific geographic address of that provider;3. be valid for one year from the date of issuance, unless revoked, suspended, modified, or terminated prior to that date, or unless a provisional license is issued;4. expire the last day of the twelfth month after the date of issuance, unless timely renewed by the ICF/DD provider;5. not be subject to sale, assignment, donation, or other transfer, whether voluntary or involuntary;6. be posted in a conspicuous place on the licensed premises at all times; and7. specify the maximum number of individuals which may be served by the ICF/DD facility.D. The licensed ICF/DD provider shall abide by and adhere to any federal, state and local laws, rules, policy, procedure, manual, or memorandums pertaining to ICF/DD provider facilities.E. A separately licensed ICF/DD provider shall not use a name which is substantially the same as the name of another ICF/DD provider licensed by the department.La. Admin. Code tit. 48, § I-8505
