Section I-5016 - Deemed Status through AccreditationA. An HCBS provider may request deemed status from the department. The department may accept accreditation in lieu of a routine on-site resurvey provided that: 1. the accreditation is obtained through an organization approved by the department;2. all services provided under the HCBS license shall be accredited; and3. the provider forwards the accrediting body's findings to the Health Standards Section within 30 days of its accreditation.B. The accreditation will be accepted as evidence of satisfactory compliance with all provisions of these requirements.C. The following may cause the state agency to perform a full licensing survey on an accredited HCBS provider: 1. any substantiated complaints in the preceding 12-month period;2. addition of service module or modules;3. a change of ownership in the preceding 12-month period;4. issuance of a provisional license in the preceding 12-month period;5. serious violations of licensing standards or professional standards of practice that were cited in the preceding 12-month period that resulted in or had the potential for negative outcomes to client's served; or6. allegations of inappropriate client treatment or services to a client resulting in death or serious injury.La.
