Section V-4703 - Restitution
A. The commission may in its discretion order restitution as follows.
1. The intent of restitution is to restore the complainant to their position as it existed prior to the licensees violation.
2. Restitution may only be rewarded for compensatory or actual loss incurred by the complainant as a direct result of the licensees violation and shall not be include general damages.
3. The executive director may include restitution within a stipulated order.
4. The commission may order restitution only after a hearing on a violation and only upon proof submitted by the complainant of compensatory or actual loss.
