Section I-1793 - Testing for Alcohol AbuseA. Any person licensed by the commission shall, when directed by the state steward, submit to a breathalyzer test and, if the results thereof show a reading of 0.05 percent or more of alcohol in the blood such person shall not be permitted to continue his duties.B. For the first offense, any person having a reading of 0.05 percent or more shall be fined $50 and not be permitted to perform his duties for the day. For the second offense, any person having a reading of .05 percent or more shall be fined $100 and not be permitted to perform his duties for the day. For a third offense, any person having a reading of 0.05 percent or more shall be suspended for 30 days and be subjected to an evaluation as called for in §1791. C. Failure or refusal to submit to a breathalyzer test when directed by the state steward shall result in a minimum seven-day suspension. Failure or refusal to submit to a breathalyzer test for a second time shall result in a suspension by the stewards to the full extent of their power and referral to the commission.La. Admin.
