Section XLIII-143 - Separate Class Prohibited

A. An LEA may not use funds available under §611 of the IDEA for classes that are organized separately on the basis of school enrollment or religion of the students if:

1. the classes are at the same site; and

2. the classes include students enrolled in public schools and students enrolled in private schools.
