Section 91-40-26 - Notice requirements(a) In providing any notice to the parent or parents of an exceptional child in accordance with K.S.A. 72-990 and amendments thereto regarding any action proposed or refused by an agency, each agency shall ensure that the notice includes the following information: (1) A description of other options that the agency considered and the reasons why those options were rejected; and (2) a description of other factors that are relevant to the agency's proposal or refusal. (b) The notice shall be written in language understandable to the general public and provided in the native language of the parent or other mode of communication used by the parent, unless it is clearly not feasible to do so. (c) If the native language or other mode of communication of a parent is not a written language, the agency shall take steps to ensure all of the following: (1) The notice is translated orally or by other means to the parent in the parent's native language or other mode of communication. (2) The parent understands the content of the notice. (3) There is written evidence that the requirements of paragraphs (1) and (2) of this subsection have been met. (d) The agency shall be required to provide a parent with a copy of the procedural safeguards available to parents only one time during each school year, except that a copy shall also be provided to the parent in the following circumstances: (1) Upon initial referral of the child for an evaluation or upon parental request for an evaluation; (2) upon receipt by the state department of education of the first complaint filed with it by the parent; (3) upon receipt by an agency of the first due process complaint filed against it by the parent; (4) upon the parent's child being subjected to disciplinary removal from the child's current placement; and (5) at any time, upon request of the parent. (e) The agency shall inform the parent of any free or low-cost legal or other relevant services available in the agency's area if the parent requests the information or the parent or agency initiates a due process complaint involving the parent's child.
