Section 80-3-16 - Military service; purchase of credit for(a) For the purpose of purchasing participating service credit under K.S.A. 74-4919h, and amendments thereto, active service in the armed forces shall not include periods of active duty for training. Periods of reserve time to fulfill the initial service requirements of 10 U.S.C. § 651(a) as in effect on the date the member's service commenced, including active duty for training, may be purchased at the rate of one quarter for each year of service in active or inactive reserves. For the purpose of determining the amount of participating service credit that may be purchased, the member's military service shall be converted to months and divided by three to determine the number of quarters that may be purchased. Any fractional remainder shall constitute a quarter that may be purchased.
(b) Notwithstanding subsection (a) of this regulation, all requirements of the uniformed services employment and reemployment rights act of 1994, chapter 43 of title 38 U.S.C., as defined in K.S.A. 74-4902(36), and amendments thereto, shall be observed by the retirement system.
