Section 47-3-3a - Application for mining permit; maps(a) Each map, plan, and cross section required for a permit application shall be certified by a qualified, licensed engineer and shall be updated as required by the secretary or secretary's designee. (b) Each change in a facility or feature that would be caused by the proposed mining operations shall be shown in the maps and plans accompanying the permit application. (1) A color code, or other method approved in writing by the secretary or secretary's designee, shall be used to indicate critical features of the permit area as follows: (A) green for areas of coal removal; (B) red for the boundary of the land affected, including access roads and haulageways; (C) brown for access roads and haulageways; and (D) blue for watercourses, impoundments, drainageways, and other water areas. (2) A color code, or other method approved, in writing, by the secretary or secretary's designee, shall be used to indicate critical features of any reclamation plan as follows: (A) green for areas of proposed grassland; (B) red for the permit boundaries; (C) brown for any roads to be left through the disturbed area; (D) blue for proposed water impoundment and drainage; (E) yellow for proposed cropland; and (F) orange for proposed woodland.
