Section 28-19-80 - Power generation facility monitoring programs(a) On or before December 31 of each year, the owner or operator of a power generation facility who, for the purpose of consideration under the provisions of K.A.R. 28-19-81, proposes to conduct any air quality or radiological environmental impact monitoring of the facility shall submit to the department of health and environment a report describing the activities proposed for the 12 month period commencing on July 1 of the following year. The report shall include, at a minimum, the following information: (1) The types of samples to be collected; (2) the method of collecting the samples; (3) the types of analyses to be conducted on the samples; (4) the number and location of the sampling sites; and (5) the sampling schedule. (b) Upon receipt of the report required under subsection (a) of this regulation, the Department shall require that all data obtained as the result of the monitoring activities be submitted, in writing, to the Department, in accordance with a schedule prescribed by the Department and provided to the plant owner or operator. (c) All data required to be reported in accordance with subsection (b) of this regulation shall be subject to quality review and evaluation by the Department. Pursuant to the conduct of this quality review and evaluation, the Department may require the owner or operator of the facility to provide additional information and conduct any additional instrumentation and analytical checks that are necessary to verify the data.
