Section 28-19-542 - Class II operating permits; permit-by-rule

(a) Any owner or operator of any stationary source that is within a source category specified in K.A.R. 28-19-561 through K.A.R. 28-19-564 may submit an application to the department for an operating permit-by-rule.

(b) Each application for a permit-by-rule shall be submitted on forms provided by the department or approved by the secretary and shall contain information sufficient for the secretary to determine the applicability of the requirements of K.A.R. 28-19-561 through K.A.R. 28-19-564 to the stationary source and the eligibility of the source to obtain a permit-by-rule.
