Section 28-19-275 - Special provisions; acid rain deposition

(a) The provisions of this regulation are in addition to any construction or operating permit requirements specified elsewhere in the Kansas air quality regulations. For stationary sources or emissions units subject to this regulation, the requirements of this regulation take precedence in cases of conflicts with other Kansas air quality regulations applicable to the stationary source or emissions unit.

(b) Where applicable, the terms used in the federal regulations adopted by reference herein shall have the definition specified at 40 CFR 72.2 as in effect on July 1, 1994, with the following exception. "Permitting authority" shall mean the secretary of health and environment.

(c) 40 CFR part 72 as applicable to phase II of the federal acid rain program and as in effect on July 1, 1994, is adopted by reference.
