If particulate matter emissions, because of their chemical and/or physical nature, require emission rates lower than those provided for in K.A.R. 28-19-20, the person responsible for the emission shall be notified by the department, in writing, of the reasons for lower emission rate restrictions for an existing or proposed contaminant emission and specify an alternate emission rate that shall not be exceeded. Such notification shall be an order as provided for in K.S.A. 65-3011 and subject to administrative and legal procedures.
