Rule 875-71.8 - Controller upgrade permits

A controller upgrade permit may be issued to allow operation of an elevator while work to upgrade controls requires deactivation of the Phase I recall initiated by smoke sensing devices. Each elevator to be altered requires a separate controller upgrade permit. The duration of a controller upgrade permit shall not exceed 90 days. Each elevator in the group shall pass inspection pursuant to rule 875-71.11 (89A) prior to being placed back into service.

(1) A controller upgrade permit shall not be issued unless each of the following conditions is met:
a. Two or more elevators share a lobby at the level of the recall floor.
b. The project includes the installation of new elevator controllers in all of the elevators in the group.
c. Phase I fire recall initiated by a key-operated switch and all other controls shall be properly functioning for each elevator available for use.
d. There is a current alteration permit for the project.
e. A complete application for the controller upgrade permit and the fee established by this chapter have been submitted and accepted.
(2) A controller upgrade permit shall not be construed to waive or excuse compliance with the requirements of any other governmental entity, including the department of public safety.
(3) Upon the submission to the labor commissioner of sufficient justification, the fee established by this chapter, and other required information, an extension of the permit for up to 60 days may be granted.
