Rule 875-1.89 - Final decision-nonlicense decision(1) When the commissioner presides over the reception of evidence at the hearing, the commissioner's decision is a final decision.(2) When the commissioner does not preside at the reception of evidence, the presiding officer shall make a proposed decision. The proposed decision becomes the final decision of the division without further proceedings unless there is an appeal to, or review on motion of, the commissioner within the time provided in rule 1.91(17A).(3) A settlement agreement, when signed by parties and the commissioner or presiding officer, is binding on all parties.Iowa Admin.
