Rule 655-20.5 - Combined statement of charges and settlement agreement

Upon a determination by the board that probable cause exists to take public disciplinary action, the board and the licensee may enter into a combined statement of charges and settlement agreement.

(1) No licensee is entitled to be offered a combined statement of charges and settlement agreement.
(2) Entering into a combined statement of charges and settlement agreement is completely voluntary.
(3) The combined statement of charges and settlement agreement shall include a brief statement of the charges, the circumstances that led to the charges, and the terms of settlement.
(4) A combined statement of charges and settlement agreement shall constitute the commencement and resolution of a contested case proceeding. By entering into a combined statement of charges and settlement agreement, the licensee waives the right to a contested case hearing on the matter.
(5) A combined statement of charges and settlement agreement is a permanent public record open for inspection under Iowa Code chapter 22.
