Rule 653-25.3 - Combined statement of charges and settlement agreement

Upon a determination by the board that probable cause exists to take formal disciplinary action, the board and the licensee may enter into a combined statement of charges and settlement agreement.

(1)Board discretion. The board has the sole discretion to determine whether to offer a licensee a combined statement of charges and settlement agreement.
(2)Voluntary agreement. Entering into a combined statement of charges and settlement agreement is completely voluntary.
(3)Contents. The combined statement of charges and settlement agreement shall include a brief statement of the charges, the circumstances that led to the charges and the terms of settlement.
(4)Resolution of the contested case. A combined statement of charges and settlement agreement shall constitute the resolution of a contested case proceeding.
(5)Open record. A combined statement of charges and settlement agreement is an open record.
