Rule 567-65.108 - [Effective until 6/19/2024] Water well separation distances for open feedlot operations
(1)Unformed settled open feedlot effluent basins. Unformed settled open feedlot effluent basins shall be separated from water wells as follows:
a.Public wells. 1,000 feet from shallow wells and 400 feet from deep wells;
b.Private wells. 400 feet from both shallow wells and deep wells.
(2)Open feed lots, solids settling facilities, formed settled open feedlot effluent basins, feed storage runoff control structures and AT systems. Open feedlots, solids settling facilities, formed settled open feedlot effluent basins, feed storage runoff control structures and AT systems shall be separated from water wells as follows: for both public wells and private wells, 200 feet from shallow wells and 100 feet from deep wells.
(3)Variances. Variances to this rule may be granted by the director if the petitioner complies with the procedures and criteria in 561-Chapter 10 and provides an alternative that is substantially equivalent to the rule or provides improved effectiveness or protection as required by the rule. Petition for a variance shall be made in writing at the time the construction permit application is submitted. The denial of a variance may be appealed to the commission.
