The commission may issue an order, in response to a completed petition or on its own motion, granting a waiver from a rule adopted by the commission, in whole or in part, as applied to the circumstances of a specified person if the commission finds, based on clear and convincing evidence, that:
(1) Application of the rule would impose an undue hardship or injustice on the person for whom the waiver is requested; and(2) A waiver of the rule on the basis of the particular circumstances relative to that specified person would be consistent with the public interest; and(3) A waiver of the rule in the specific case would not prejudice the substantial legal rights of any person.Iowa Admin.
