Rule 281-120.437 - Convenience of hearings and timelines

(1)Time and place. Any due process hearing conducted under this chapter must be carried out at a time and place that is reasonably convenient to the parents.

(2)Timeline for ALJ decision. The department must ensure that, not later than 30 days after the receipt of a parent's due process complaint, the due process hearing required under this chapter is completed and a written decision mailed to each of the parties.

(3)Extension of ALJ timeline. An ALJ may grant specific extensions of time beyond the period set out in subrule 120.437(2) at the request of either party.
