Rule 21-96.12 - Negligent violation program
(1) The department shall require the completion of a corrective action plan for negligent violations. A licensee shall submit a corrective action plan to the department for consideration and approval. A corrective action plan shall consist of the following:
a. A reasonable time period, approved by the department, for correcting a negligent violation. Failure to correct a negligent violation within the reasonable time period shall be considered an additional negligent violation.
b. A proposed schedule for the licensee to submit periodic compliance reports to the department, when applicable. The duration for the ongoing compliance reports shall not be less than two calendar years following the violation.
c. Any other requirement established by the department.
(2) The department may conduct any inspection, review, or other action to determine if the corrective action plan has been implemented as approved by the department.
(3) The department shall issue a certificate of completion to the licensee upon the successful completion of the corrective action plan.
(4) A licensee who is participating in, or who successfully completes, the corrective action plan shall not be subject to any criminal enforcement action pertaining to the negligent violations by the federal, state, tribal, or local government.
