Rule 161-4.29 - Waiver, modification of rules
(1)By presiding officer. Upon notice to all parties, the presiding officer may, with respect to matters pending before the presiding officer, modify or waive any rule herein upon a determination that no party will be prejudiced and that the ends of justice will be served.
(2)By parties. Unless otherwise precluded by law, the parties in a contested case proceeding may waive any provision of this chapter However, the presiding officer, in the discretion of the presiding officer, may refuse to give effect to such a waiver when the presiding officer deems the waiver to be inconsistent with the public interest.
