Section 760 IAC 1-38.1-13 - Order of benefits for dependent child/parents not separated or divorced

Sec. 13.

(a) For a dependent child whose parents are:

(1) married; or

(2) living together, whether or not they have ever married;

the benefits of the plan of the parent whose birthday falls earlier in a calendar year is [sic., are] the primary.

(b) If both parents have the same birthday, the plan that has covered the parent longest is the primary plan.
