Section 760 IAC 1-19-2 - Pre-existing condition limitations

Sec. 2.

LIMITATIONS. In the case of persons insured under a prior carrier's group disability policy at the date of change in coverage to a succeeding carrier's group disability policy containing a pre-existing conditions limitation, during the period of time the limitation applies under the new policy, the level of benefits shall be the lesser of

(a) the benefits of the new plan determined without application of the pre-existing conditions limitation; or

(b) the benefits of the prior plan.
