Sec. 74.
"Public official" means a person who is:
(1) authorized to perform an official function on behalf of, and is paid by a governmental entity, as defined in IC 35-41-1-12[IC 35-41-1-12 was repealed by P.L. 114-2012, SECTION 105, effective July 1, 2012.];(2) elected or appointed to office to discharge a public duty for a governmental entity; or(3) appointed in writing by a public official to act in an advisory capacity, with or without compensation, to a governmental entity concerning a contract or purchase to be made by the entity. This term does not include a person appointed to an honorary advisory or honorary military position.
