Sec. 2.
(a) The activities undertaken to carry out child find responsibilities for nonpublic school students with disabilities must be as follows: (1) Comparable to activities undertaken for students with disabilities in public schools.(2) Completed in a time period comparable to that for students attending public schools in the public agency. Public agencies may not delay conducting child find activities, including individual evaluations and reevaluations, until after child find activities for public school students are conducted.(b) The cost of child find activities, including the cost of individual evaluations and reevaluations, must not be considered in determining whether a public agency has met its proportionate share requirement in section 7 of this rule.(c) Each public agency must maintain in its records, and provide to the division of special education, the following information related to parentally-placed nonpublic school students with disabilities: (1) The number of students evaluated.(2) The number of students determined to be students with disabilities.(3) The number of students served.(d) The number of students served in subsection (c)(3) must be used to calculate a public agency's proportionate share requirement as specified in section 7 of this rule.
