Sec. 46.
"Homeless students" has the meaning given the term "homeless children and youths" in the McKinney-Vento Homeless Assistance Act, as amended, 42 U.S.C. 11431 et seq. The term means individuals who lack a fixed, regular, and adequate nighttime residence, and includes the following:
(1) Children and youths who are: (A) sharing the housing of other persons due to: (ii) economic hardship; or(B) living in: (iv) camping grounds; due to the lack of alternative adequate accommodations;
(C) living in emergency or transitional shelters;(D) abandoned in hospitals; or(E) awaiting foster care placement.(2) Children and youths who have a primary nighttime residence that is a public or private place not designed for or ordinarily used as a regular sleeping accommodation for human beings (within the meaning of 42 U.S.C. 11302(a)(2)(C)) .(3) Children and youths who are living in: (F) bus or train stations; or(4) Migratory children, as such term is defined in the Elementary and Secondary Education Act of 1965, who qualify as homeless because the children are living in circumstances described in subdivisions (1) through (3).Indiana State Board of Education; 511 IAC 7-32-46; filed Jul 14, 2008, 1:24 p.m.: 20080813-IR-511080112FRAReadopted filed 11/6/2014, 3:23 p.m.: 20141203-IR-511140382RFA
