Sec. 7.
(a) Participating agencies shall provide notice that is adequate to fully inform parents about the following:(1) A description of the extent that the notice is given in the native languages of the various population groups in the state.(2) A description of:(A) the children on whom personally identifiable information is maintained;(B) the types of information sought;(C) the methods the participating agencies intend to use in gathering the information, including the sources from whom information is gathered; and(D) the uses to be made of the information.(3) A summary of the policies and procedures that participating agencies must follow regarding:(B) disclosure to third parties;(D) destruction; of personally identifiable information.(4) A description of all of the rights of parents and children regarding the information described in this section, including the rights provided through the Family Educational Rights and Privacy Act and the implementing regulations in 34 CFR 99.(b) Before any major identification, location, or evaluation activity, the notice identified in subsection (a) must be published or announced in newspapers or other media, or both, with circulation adequate to notify parents throughout the state of the activity.Division of Family Resources; 470 IAC 3.1-13-7; filed Jan 29, 1996, 5:15 p.m.: 19 IR 1348; readopted filed Jul 12, 2001, 1:40 p.m.: 24 IR 4235; readopted filed Oct 24, 2007, 11:25 a.m.: 20071121-IR-470070448RFA; readopted filed Aug 23, 2013, 3:36 p.m.: 20130918-IR-470130306RFAReadopted filed 11/13/2019, 11:56 a.m.: 20191211-IR-470190490RFA
