Sec. 54.
(a) The department may require written operating permits as follows: (1) A written operating permit issued by the department shall be signed by the commissioner or his duly authorized representative.(2) An operating permit shall be renewed as follows:(A) At least once every three (3) years for on-site sewage systems having components, other than a septic tank, requiring scheduled inspection and maintenance.(B) At least once every five (5) years for all other on-site sewage systems.(b) An operating permit shall identify all components of an on-site sewage system requiring inspection and maintenance.(c) The records for an operating permit requiring scheduled inspection and maintenance shall contain the following:(1) The name, address, and telephone number of the service company contracted to perform inspection and maintenance.(2) A description of the operation and maintenance document or documents used for scheduled inspection and maintenance.(d) The owner shall provide the department with the following:(1) Written documentation of all scheduled and unscheduled inspection and maintenance within one (1) month of the date performed.(2) A copy of the inspection and maintenance contract.(e) The operating permit for a commercial on-site sewage system in violation of subsection (d) may be revoked by the department in accordance with section 56 of this rule.(f) Nothing in this rule shall be construed as preventing requirements in local ordinance for the issuance of an operating permit for a commercial on-site sewage system, provided that the permit required by local ordinance is not in conflict with an operating permit issued by the department.Indiana State Department of Health; 410 IAC 6-10.1-54; filed Oct 19, 2012, 2:07 p.m.: 20121114-IR-410120157FRAReadopted filed 9/26/2018, 2:48 p.m.: 20181024-IR-410180328RFA
